# Determination of Reimbursable Amount

(a) Except for Resource and Referral programs and Alternative Payment type programs, all contractors shall be reimbursed for an audited claim that is the least of the following:&#x20;

&#x20;             (1) The maximum reimbursable amount as stated in the annual child development contract; or&#x20;

&#x20;             (2) The net reimbursable program costs; or&#x20;

&#x20;             (3) The product of the adjusted child days of enrollment for certified children, times the contract rate per child day of enrollment, times the actual percentage of attendance plus five percent (5%), but in no case to exceed one hundred percent (100%) of enrollment;&#x20;

(b) Resource and Referral programs will be reimbursed for the lesser of subdivisions (a)(1) or (a)(2) of this section.&#x20;

(c) Alternative Payment type programs shall be reimbursed for an audited claim that is the least of the following:&#x20;

&#x20;             (1) The maximum reimbursable amount as stated in the annual child development contract; or&#x20;

&#x20;             (2) The amount earned, which is reimbursable expenditures of:&#x20;

&#x20;                           (A) direct payments to providers, which includes family fees for certified children and interest earned on advanced contract funds; and&#x20;

&#x20;                           (B) actual administrative and support costs directly related to child care services provided, which combined cannot exceed the allowable percentage of the total contract amount.
